If I buy new property say in Jan.10, and sell my old property in May,10 then can the proceeds of old propery(holding for more than 3 years and is my residence also)be directed to new one as investment in new flat or i will be applied capital tax gain.

I am planning to buy a property in Royal Palm, Near Film City, Goregaon (E), Mumabi. I am told that I can get loan from State Bank of India for buying this property. But there are many stories in the air, associated with the legal status of the land in Royal Palm area. Kindly clear my doubts. Is the land in this area is illegal? Will the flat be illegal even when I get SBI loan for buying the same? I am very much confused. Pl guide me whether I should go for buying a flat in Royal Palm (Summit Apartment) or not. would like to know what is the exact procedure for payment of a resale flat in miraroad. we have already paid token money and also paid stamp duty. The owner had put a condition that we must pay 15% amount within 15 days. But we requested him to give us some time because due to unavailability of some document our bank has halted the loan clearance. Now the owner is saying that there is a rule that if the amount is not provided within 1 month to the owner than the deal gets canceled. Is it so. We also came to know that stamp duty should not be paid before complete verification of property. Please advise
