I have purchased a office in Ghatkopar,Mumbai. Now the Society is refusing to transfer the share certificate in my name as the earlier share certificate was transferred on sellers name just two months before our agreement. Now as per society, we have to wait until one year. Is this right ? Also one year will be considered from the date of last transfer of share certificate or from the date of last agreement our seller has made ?

Legally the Society is not obliged to transfer your share certificate one year from the date of the last transfer. However you can submit your application for transfer in the prescribed format. In the mean time you might want to sell your property and the new buyer may insist on the tranfer being effected. In some cases a mere NOC from the society can be used for the purpose of convincing the new buyer that all papers are in order.
