legal docs to look for in case of flat sale of deceased owner
Hi,
The Muslim flat owner (father)is deceased. The mother is the power of attorney of the flat and she also has expired. Now, both the children; brother and sister want to sell the property. They just have father's will and Succession certificate. What all documents are required to take in consideration to sell this flat? Is probate compulsory in this case? How long does it take to transfer the flat on children name?

Yes a probate is compulsory to establish the ownership of the property. Once a probate is got the property can be transfered to the names of the brother and sister in the proportion stated in the will. The entire process may take upto 9 months.
